We are writing to notify you the issuance of the Provision No DI-2016-84-E-APN-SCYCI#MRE dated Thursday 04 August 2016, at attached hereto , by which has been failed the Tender to Lease a Property for The Official Residence of The Embassy of Argentina in United Arab Emirates.


Also, is hereby given that against aforementioned administrative act the resources provided in Articles 84,88 and 89 of the Executive Order No 1759/72 of the National Administrative Procedures Law of  No 19.549 maybe logged within the deadlines provided for that purpose, in the above regulations.

Reference: FILE No 20240/2015- APPROVE PROCESS FOR PRIVATE TENDER EEARB NO 3/2016


In reference to the file No 20240/2015 of the Registry of the Ministry of Foreign Affairs and Worship, the Amending Executive Orders No 1023 from 13th August 2001 y 893 from 07th June de 2012 , the Resolution No 91 from 10th February 2016 of The Secretariat of International Coordination and Cooperation, and


CONSIDERING:

That by the Resolution No 91/16 of The Secretariat of International Coordination and Cooperation, the Special Bidding Terms and Conditions and the Private Tender Announcement for the lease of a Property for The Official Residence of The Embassy of Argentina in United Arab Emirates were approved.

That the Mission dated 30 March 2016 proceed to invite FIVE (5) potential bidders specifying the deadline to submit the offers.

That in compliance with the terms provided by Art. 50 of the Rules of the Regulations Governing Public Administration procurements approved by the Executive Order No 893/12, dated 07 of April 2016, the opening of the offers received from the firms FOUNDATION PROPERTY MANAGEMENT, GULFSOTHEBY´S INTERNATIONAL REALITY and ABDULLA MATAR AHMED ALMANSOORI was performed.

That the General Directorate of Infrastructure, Services and Property Management informed, through  Memorandum No 105/2016 dated 19 April 2016, that all the properties exceed the maximum surface required by Point 1) of the Technical Specifications. Consequently, the offers do not meet the technical terms of The Special Bidding Terms and Conditions.

That the Evaluation Committee issued its evaluation report No 3/2016 dated 29 April 2016 expressing that all the offers exceed the maximum surface required by the Point 1) of The Technical Specifications of The Special Bidding Terms  and Conditions. Therefore, the Evaluation Report indicated that the offers contain an essential error not subject to be corrected under the provisions on Art. 84 section k) of The Rules of the Regulations Governing Public Administration approved by the Executive Order No 893/12. Consequently, the Evaluation Committee recommended to dismiss the offers and declare the Private Tender EEARB No 3/2016 unsuccessful.

That the aforementioned Evaluation Report was communicated to the Offerors according to the provisions Art 92 of the Executive Order No 893/12, not receiving any appeals within the legal timeframes.

That in accordance with the above mentioned, it is necessary to declare the Private Tender EEARB No 3/2016 unsuccessful and to proceed to issue a second invitation to bid for the lease the abovementioned Property.

That in accordance to what the Mission informed, The General Directorate of Infrastructure, Services and Property Management changed the Technical Specifications, setting as maximum enclosed surface of the property SIX HUNDRED AND FIFTHY SQARE METERS (650M2).

That the estimate amount of the contract is THREE HUNDRED THIRTY TWO THOUSAND THREE HUNDRED TWENTY NINE AMERICAN DOLLARS (USD 332,329.-), for the lease of the property for ONE (1) year, with the renewal option for the same period, security deposit, realtor fees and notary´s fees.

The Procurement and Contracting department endorses this action.

The Budged Department took part in the process according with its area of remit.

The General Directorate of Administration and The General Directorate of Infrastructure, Services and Property Management have taken part in this process according with to their respective remit.

The General Directorate of Legal Affairs has taken part in the process in accordance with its remit.

The present action is issued based on the faculties conferred by the Articles 14, sections a), b) and c) of Rules of the Regulations Governing Public Administration approved by  Executive Order  893/12, amended by the Executive Order No 1039 dated 29 July 2013.

THE SUBSECRETARY OF INTERNATIONAL COORDINATION AND COOPERATION

DECLARES:

ARTICLE 1o.- Approval the private tender process EEARB No. 3/2016 related to Lease a Property for The Official Residence of The Embassy of Argentina in UNITED ARAB EMIRATES.

ARTICLE 2o.- Dismiss the bids submitted by FOUNDATION PROPERTY MANAGEMENT; GULF SOTHEBY´S INTERNATIONAL REALITY y ABDULLA MATAR AHMED ALMANSOOR for the reasons stated previously in the Provision.

ARTICLE 3o.- Declare unsuccessful  The Private Tender EEARB No 3/2016.

ARTICLE 4o.- Authorize the announcement for a second invitation to the private tender EEARB No 3/2016 in order to lease a property for The Official Residence of The Embassy of Argentina in UNITED ARAB EMIRATES.

ARTICLE 5o.- Approve the Special Bidding Terms and Conditions for the Lease of a Property for The Official Residence of The Embassy of Argentina in UNITED ARAB EMIRATES, contained in the Annex (IF-2016-00331038-APN-DCYC#MRE) on this provision.

ARTICLE 6o.- Register, inform and filed.
